PLEASE READ THESE TERMS OF USE CAREFULLY BEFORE USING THIS WEBSITE. By using this website, you signify your consent to these Terms of Use. If you do not agree to these Terms of Use, please do not use the website.
Your access to and use of this website, as well as all related websites and online services operated by Natasha McKenna, trading as “Tash McKenna” (the “Company”, “we”, “us” or “our”), which include www.tashmckenna.com and www.truforgivenessbusiness.com, the membership and course area hosted on Kajabi, and the checkout and course-delivery pages hosted on ThriveCart at courses.tashmckenna.com and courses.truforgivenessbusiness.com (collectively the “Site”), is subject to the following terms and conditions (“Terms of Use”) and all applicable laws. By accessing and browsing the Site, or by purchasing any product or service offered through it, you accept, without limitation or qualification, these Terms of Use and acknowledge that any other agreements between you and the Site are superseded and of no force or effect, except for the platform checkout terms referenced in clause 14.
1. You agree that the Site itself, as well as all content, videos, training materials, products, giftbooks, services and/or other materials made available on the Site by us or other third parties, as well as the look and feel of all of the foregoing (collectively the “Content”), are maintained for your personal use and information by the Company and are the property of the Company and/or its third-party providers. You agree that such Company Content includes all proprietary videos, HTML/CSS, JavaScript, graphics, voice and sound recordings, artwork, photos, documents and text, as well as all other materials included in the Site, excluding only the materials you provide. Subject to your compliance with these Terms of Use, the Company grants you a limited licence, which is non-exclusive, non-transferable and non-sublicensable, to access, view and use the Site solely for your personal purposes. No Company Content may be copied, reproduced, republished, uploaded, posted, transmitted, distributed, used for public or commercial purposes, or downloaded in any way unless written permission is expressly granted by the Company. Modification of the Content or use of the Content for any other purpose is a violation of the copyright and other proprietary rights of the Company, as well as other authors who created the materials, and may be subject to monetary damages and penalties.
2. All Content, such as text, data, graphics files, videos and sound files, and other materials contained in the Site, is copyrighted unless otherwise noted and is the property of the Company and/or a supplier to the Company. No such materials may be used except as provided in these Terms of Use.
3. All trade names, trademarks, and images and biographical information of people used in the Company Content and contained in the Site, including without limitation the name and trademarks, are either the property of, or used with permission by, the Company. The use of Content by you is strictly prohibited unless specifically permitted by these Terms of Use. The Company has the right, but no obligation, to remove content and accounts containing materials that it deems, in its sole discretion, to be unlawful, offensive, threatening, libellous, defamatory, pornographic, obscene or otherwise objectionable, or that violate any party’s intellectual property or these Terms of Use. If you believe your intellectual property rights are being violated, you may notify the Company at [email protected] with your name and contact information, the nature of your work and how it is being violated, all relevant copyright and/or trademark registration information, the location/URL of the violation, and any other relevant information. Truforgiveness Business™ and The Treasure Map of Truforgiveness, FAITH & the ‘I Forgive’ Principle are copyrighted by Natasha McKenna. Please do not refer to this work without referencing Tash McKenna.
4. While the Company uses reasonable efforts to include accurate and up-to-date information on the Site, the Company makes no warranties or representations as to its accuracy. The Company assumes no liability or responsibility for any errors or omissions in the content of the Site.
5. When you register with the Company and/or this Site, you expressly consent to receive notices, announcements, agreements, disclosures, reports, documents and communications concerning new products or services or other records or correspondence from the Company, including by email. You also consent to inclusion on the list used for email marketing by Tash McKenna. You may withdraw your consent to marketing communications at any time using the unsubscribe link in any marketing email or by contacting us, without affecting communications that relate to a purchase you have made.
6. If you send comments or suggestions about the Site to the Company — including notes, text, drawings, images, designs or computer programs — such submissions shall become and shall remain the sole property of the Company. No submission shall be subject to any obligation of confidence on the part of the Company. The Company shall exclusively own all rights to (including intellectual property rights in) such submissions and shall be entitled to unrestricted use, publication and dissemination of them for any purpose, commercial or otherwise, without acknowledgment or compensation to you.
7. The Company shall use commercially reasonable efforts to restrict unauthorised access to our data and files. However, no system, whether or not password protected, can be entirely impenetrable. You acknowledge that it may be possible for an unauthorised third party to access, view, copy, modify or distribute the data and files you store using the Site. Use of the Site is at your own risk.
8. Tash McKenna reserves the right to refuse to work with people she feels will not benefit from this work, will be disruptive to the group, or are not suitable for this new way of true healing.
9. The work taught by Tash McKenna — including The Treasure Map of Truforgiveness, FAITH & the ‘I Forgive’ Principle, and Truforgiveness Business™ — is about removing the darkness that covers the truth within, and taking accountability for your own position that you face. Results cannot be guaranteed, nor can the direction the path before you takes as you forgive within. If you wish to undertake any work with Tash McKenna you must be willing to be accountable for what you find in the subconscious mind that you will be taught to truly forgive. You release Tash McKenna and the work she teaches from being liable for anything you should find or face. If you do not agree to this, please do not dive into this work. This holds true for your family, friends, business associates, and others.
10. The Company will not intentionally disclose any personally identifying information about you to third parties, except where the Company, in good faith, believes such disclosure is necessary to comply with the law or enforce these Terms of Use. Our collection and use of your personal information is governed by our Privacy Policy, which is incorporated into these Terms of Use by reference. We process personal data in accordance with applicable data-protection laws, which may include the EU and UK General Data Protection Regulation (GDPR) and the California Consumer Privacy Act / California Privacy Rights Act (CCPA/CPRA). By using the Site, you signify your acceptance of the Privacy Policy. If you do not agree with it, in whole or in part, please do not use this Site.
11. Cookies. The Site uses cookies and similar technologies. We use only cookies that are essential to operate the Site and to process your purchases — for example, login/session and checkout cookies set by our platform providers (Kajabi and ThriveCart). We do not currently use analytics or advertising cookies. A notice about our use of cookies is shown when you first visit the Site, and full details are set out in our Privacy Policy. By continuing to use the Site, you consent to our use of essential cookies as described there.
12. Refunds. The following refund policy applies to products and services purchased through the Site:
- Kajabi University: a full 30-day money-back guarantee of FAITH applies. If you are not happy, contact us within 30 days of your purchase date to request a refund.
- All purchases through ThriveCart (courses.tashmckenna.com and courses.truforgivenessbusiness.com): these are instant digital downloads, so all sales are final and no refunds are offered. Please be certain of your purchase before buying.
All purchases are also subject to the checkout and billing terms of the platform through which you bought them (see clause 14). Where a product is sold on a recurring or subscription basis, the cancellation and auto-renewal terms in clause 13 also apply. To request a refund, contact us at [email protected].
13. Subscriptions and automatic renewal. Some products (including the University membership) are offered on a recurring subscription or continuous-service basis. Where this applies:
- Before you complete your purchase, we will clearly and conspicuously disclose the renewal terms, the recurring price, the billing frequency and the length of the subscription.
- Your subscription will automatically renew at the then-current price and interval until you cancel, and you give your express affirmative consent to these renewal terms at checkout.
- After purchase, you will receive an acknowledgment containing the subscription terms and clear instructions on how to cancel.
- You may cancel at any time through your account / the same method you used to subscribe, or by contacting us at [email protected]. Cancellation takes effect at the end of the current paid billing period and stops future renewals; it does not retroactively refund the current period except as required by law or the refund policy in clause 12.
- For auto-renewing plans, we will send periodic renewal reminders as required by applicable law.
14. Third-party platforms and payment processors. The Company is not responsible for any performance or service problems caused by any third-party website, platform or service provider — including, for example, your web/internet service provider, the platforms through which products are sold and delivered (such as Kajabi and ThriveCart), and their payment processors (such as Stripe and PayPal), together with your own software and any updates to it. Any such problem shall be governed solely by the agreement between you and that provider, including that provider’s own checkout, billing and refund terms. The Company reserves the right to determine, in its sole discretion, whether it is responsible for any such malfunction or disruption, and the right to limit your use of the Site and/or the Content, or to terminate your account, should the Company determine that you have violated these Terms of Use or any other rules or conditions of the Company. The Company reserves the right to refuse access to the Site and/or the Company’s Content, products and/or services to anyone in its sole discretion.
15. No professional advice. The Content is provided for educational, spiritual and personal-development purposes only. It is not, and is not a substitute for, professional medical, psychological, psychiatric, therapeutic, financial or legal advice, diagnosis or treatment. Nothing on the Site is intended to diagnose, treat, cure or prevent any condition. You should always seek the advice of a qualified professional with any questions you may have regarding your health, mental health, finances or legal situation, and you should never disregard or delay seeking professional advice because of something you have read or accessed on the Site. Your use of the Content is at your own risk and responsibility.
16. Eligibility / minimum age. You must be at least 18 years old (or the age of majority in your jurisdiction, if higher) to purchase products or services or to create an account on the Site. By using the Site or purchasing from it, you represent and warrant that you meet this requirement and that the registration and payment information you provide is accurate.
17. NEITHER THE COMPANY NOR ANY OTHER PARTY INVOLVED IN CREATING, PRODUCING OR MAINTAINING THE SITE AND/OR ANY CONTENT ON THE SITE SHALL BE LIABLE UNDER ANY CIRCUMSTANCES FOR ANY DIRECT, INCIDENTAL, CONSEQUENTIAL, INDIRECT OR PUNITIVE DAMAGES ARISING OUT OF YOUR ACCESS TO OR USE OF THE SITE. WITHOUT LIMITING THE FOREGOING, ALL CONTENT ON THE SITE IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. THE COMPANY DOES NOT WARRANT OR MAKE ANY REPRESENTATIONS REGARDING THE USE OF THE MATERIALS ON THE SITE, THE RESULTS OF SUCH USE, THE SUITABILITY OF SUCH MATERIALS FOR ANY USER’S NEEDS, OR THE LIKELIHOOD THAT THEIR USE WILL MEET ANY USER’S EXPECTATIONS. YOU ACCEPT ALL RESPONSIBILITY FOR EVALUATING YOUR OWN LEARNING AND TAKE FULL ACCOUNTABILITY FOR YOUR JOURNEY. THE MATERIAL IS PROVIDED IN GOOD FAITH AND ON THE PREMISE THAT IF YOU ENCOUNTER DARKNESS, IT IS YOURS TO BEGIN WITH. THERE WILL BE NO BLAME OF NATASHA MCKENNA FOR WHAT YOU ENCOUNTER ON THE JOURNEY WITHIN, FOR YOUR HEALING IS AT YOUR OWN HANDS. FOR THOSE WHO UNDERTAKE TRUFORGIVENESS SESSIONS WITH NATASHA MCKENNA, SHE WILL NOT BE HELD LIABLE FOR WHAT YOU ENCOUNTER OR THE OUTCOME OF THAT SESSION. IF YOU DO NOT AGREE TO THIS, DO NOT MOVE FORWARD WITH A TRUFORGIVENESS THERAPY SESSION. THE MATERIAL ON THIS SITE CANNOT BE TAUGHT IN ANOTHER CAPACITY BY ANOTHER PERSON UNLESS WRITTEN AUTHORITY HAS BEEN PROVIDED BY NATASHA MCKENNA. THE COMPANY DOES NOT WARRANT THAT USE OF THE MATERIALS WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THIS SITE AND ITS MATERIALS ARE FREE FROM BUGS, VIRUSES OR OTHER HARMFUL COMPONENTS. Please note that the applicable jurisdiction may not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you.
18. IN NO EVENT SHALL THE COMPANY BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, PUNITIVE, RELIANCE OR CONSEQUENTIAL DAMAGES, WHETHER FORESEEABLE OR NOT, INCLUDING BUT NOT LIMITED TO DAMAGE OR LOSS OF PROPERTY, EQUIPMENT, INFORMATION OR DATA, LOSS OF PROFITS, REVENUE OR GOODWILL, COST OF CAPITAL, COST OF REPLACEMENT SERVICES, OR CLAIMS FOR SERVICE INTERRUPTIONS OR TRANSMISSION PROBLEMS, OCCASIONED BY ANY DEFECT IN THE SITE, THE CONTENT AND/OR RELATED MATERIALS, THE INABILITY TO USE SERVICES PROVIDED HEREUNDER, OR ANY OTHER CAUSE WHATSOEVER, REGARDLESS OF THEORY OF LIABILITY. THIS LIMITATION APPLIES EVEN IF THE COMPANY HAS BEEN ADVISED OF OR IS AWARE OF THE POSSIBILITY OF SUCH DAMAGES.
19. You agree to indemnify and hold the Company and each of its directors, officers, employees and agents harmless from any and all liabilities, claims, damages and expenses, including reasonable attorneys’ fees, arising out of or relating to (i) your breach of these Terms of Use, (ii) any violation by you of law or the rights of any third party, (iii) any materials, information, works and/or other content of whatever nature or media that you post or share on or through the Site, (iv) your use of the Site or any services the Company may provide via the Site, and (v) your conduct in connection with the Site or the services or with other users. The Company reserves the right to assume the exclusive defence of any claim for which it is entitled to indemnification, in which event you shall provide reasonable cooperation.
20. The provisions of these Terms of Use are for the benefit of the Company, its subsidiaries, affiliates and its third-party content providers and licensors, and each shall have the right to assert and enforce such provisions directly or on its own behalf.
21. This agreement shall be governed by and construed in accordance with the laws of the State of California, without giving effect to any principles of conflicts of law. You further submit to the exclusive jurisdiction of the state and federal courts sitting in Orange County, California. If any provision of this agreement is unlawful, void or for any reason unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.
22. These Terms of Use may be revised from time to time by updating this posting. You are bound by any such revisions and should periodically visit this page to review the then-current Terms of Use to which you are bound.
